Teach minor how to smoke weed

If a person (20years old) teaches how to smoke weeds to minors and give party on college election of alcohol to minors (17 years old) what offences can be charged on him if it can be proven according to the pictures and whole society knows that he has done that offence.

Dear Sir/Madam,

It is very disheartening to hear about such happenings in our society. From what we understand from the question is that the person concerned taught the minors how to smoke weed and gave them an alcohol party. We also get that you are concerned about those children, getting affected by such teachings. But unfortunately, merely teaching minors or just providing them with the knowledge of something illegal i.e. alcohol and smoking weed, doesn’t count as an offence. Because of the fact that they are minors, all the focus gets shifted to only one statute, namely – Juvenile Justice (Care and Protection of Children) Act, 2015. Now, under the said law a person cannot be tried on the ground that he was teaching the kids about smoking weed.

Had he been, providing the children with abovementioned substances or helping the kids score them in any manner, he could have definitely come under the purview of the above discussed law and one could very well file a complaint against him in the criminal court under section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015.

As per section 77 of the act, if any person gives, or causes to be given, to any child any intoxicating liquor or any narcotic drug then he/she shall be punished with an imprisonment up to 7 years or fine up to one lakh rupees.
