Supreme court / mumbai high court citation for no maintenance

  • 1 Answer

Hello Experts, Can anyone please provide Supreme Court OR Mumbai High Court judgements passed for no maintenance to well educated / capable women at the earliest please ???? My revision petition is pending in the Bombay High court, so any lower court citations or citations from any other high court except Bombay High Court would not be considered. Can anyone PLEASE send me supreme court or Bombay High Court citations ??? I have searched over the internet but could not find any. I would highly appreciate if anyone can help me get one.

In the recent case of Sunita Kachwaha And Ors vs Anil Kuchwaha on 28 October, 2014 (CRIMINAL APPEAL NO. 2310 OF 2014 Arising out of SLP (Crl.) No. 2659/2012), the division bench of the Supreme Court of India has commented on this issue. The Supreme Court in this case stated that the inability of the woman to maintain herself is the precondition for granting maintenance. It was further stated that in this case that the wife must positively aver and prove that she is unable to maintain herself, in addition to the fact that her husband has sufficient means to maintain her and that he has neglected to maintain her.
