I am opening an e-business for which I want to know all legal formalities that are must to complete for starting an e-business, like incorporation, license, documents needs, etc.

For starting an e-business, the first thing that you can do is register your domain name and set up the website. Then for registration, it is essential to apply for and obtain the Director Identification Number (DIN) and Digital Signature Certificate (DSC). This can be done on the official website of the Ministry of Corporate Affairs (https://www.mca.gov.in/content/mca/global/en/home.html) where these options can be found under ‘MCA Services’. After obtaining the two, you must get the name of your company approved. For this, eForm 1A which can be found on the website must be filled. Alternatively, instead of the MCA website, you can apply to the Registrar of Companies offline as well. You can then apply for GST certification, Permanent Account Number and Tax Deduction Account Number. Also, draft the Memorandum of Association and Articles of Association during this period. Once you get the certificate of incorporation upon filling all necessary forms for the aforesaid either online or offline, you can commence your business. You will also need to open a bank account in the name of your company. You can then set up payment gateways on your site.
