Refusal of refund by Immigration Consultancy Firm

  • 1 Answer

Hi, I have enrolled with a immigration consultant (http://skillsinternational.com) to move to Canada under Canadian Express Entry program in 2014 and paid 6500 US Dollors as an overall fee. However after 3 years, the consultant has shut down his office and now he has told us that no amount will be refunded as it was clearly mentioned in the contract. Please advise.

In the case, if the contract expressly maintain that in case of closure of the office, there would not be a refund process. Therefore, it is valid contract. Now, the office is closed then you don't have right to ask for refund as you have already consented at the time of acceptance which is one of the main essential element of the contract under Section 10 of the Indian Contract Act, 1872.
