pay scale associate professor

Sir, I joined as Assistant Professor on 18.12.1996. I was promoted to Associate Professor on 11.07.2006 in the pay scale of 15600-39100 with AGP 8000. Again, I got Pay scale of 37400-67000 with AGP of 9000 from 11.07.2009. I was I/C Programme Coordinator from 18.12.2006. In a Direct Interview of Programme Coordinator (Equivalent to Associate Professor) I was selected and joined on 31.05.2015 but the Pay Scale advertised for the post was 15600-39100 with an AGP of 8000 though it should be 37400-67000 with AGP of 9000). Now, the question is 1. Should I get 37400-67000 with AGP of 9000) or be put in 15600-39100 with AGP of 8000. 2. Shall I loose my seniority from 11.07.2006 as Associate Professor 3. Shall I be downgraded from AGP 9000-AGP 8000 4. The UGC norm says that a person selected through Direct Interview shall be put in 37400-67000 with AGP of 9000) since appointment 5. should I resign from the present post and join my earlier post because both the posts are in the same University and same location

As per the 6th Pay Commission, a direct recruit is entitled to a minimum wage. However the UGC rules also mention how every appointment should be made by giving advertisements in the newspaper. Therefore if the advertisement mentions a particular grade pay, you have to go by it.

However, in a RTI reply, it was cleared that if an anomaly exists whereby a junior direct recruit(DR) gets paid more than a senior official by way of promotion, the National Anomaly Commission(NAC) will increase the pay of the senior officer. The case where a senior official is brought down by virtue of being a Direct Recruit is not mentioned. However, every post comes within a particular pay band and it would be irrelevant if you being a more experienced official are applying for a post whose pay band is lesser. However, if a Program Coordinator is equivalent to Associate Professor(different states have put this post under different categories), you can file a report in front of the NAC and they will resolve this ambiguity.

There is no mention in the UGC norms that a direct recruit should get 37400-67000 with AGP of 9000. According to the 6th Pay Commission, only pay bands are mentioned for different Pay groups. As mentioned, Programme coordinator has not been specifically mentioned in the UGC rules and also differs from state to state, as every state has their own Service Rules, you can challenge the advertisement if it is equivalent to Associate Professor.
