Order confirmation form and its terms

1. What is an Order confirmation Form? 2. How binding are terms printed on backside? 3. If Company violates terms, is refund in full possible? 4. How to get refund, if Company does not respond?

Ma’am and order confirmation form/template is a document issued by the seller to the buyer

to confirm the details of the order placed before actually delivering it. It must be understood

that this document is not any form of contract nor it a bill or proof of a contract and only

gives an abstract and specifications of your order. Thus, no terms mentioned in it are binding

and can be challenged.

Further If company violates it terms then it would be breach of contract and can be

challenged under Section 73 of the Indian Contract Act which grants compensation to a party

that has suffers damages due to breach of contract by another party. To get refund and

compensation an order of perpetual injunction must be begotten from a court of law under

Section 37 of the Specific Relief Act 1963.
