NGO Registration

I registered NGO, i wish to restrict other from use name and logo of my NGO. there i need to do any other thing than NGO registration.

You can protect the name and logo of your NGO by applying for Trademark Registration. Trademark provides protection to things that provides identification to a business in the market and hence, name and logo can be protected from any third party use or infringement through trademark.



After a comprehensive search for similar marks, you can file an application for trademark registration under S. 18 of The Trade Marks Act, 1999 [1](referred to as The Act herein).  You can file the trademark application, along with the fees, to the Registrar having the jurisdiction for the city where you have established the NGO. The application should consist:

1. The name and Logo of the NGO;

2. Name and address of the owner of the said marks, i.e., your name and address in this case;

3. Registration under appropriate trademark class or classification. There exist mainly 45 classes of goods and services under trademark classification in India, you can select the class suitable for your NGO and register the name and Logo accordingly;

4.The date since when the said mark is being used; and

5. Description of the goods/services provided by the NGO.



S. 28 of The Act[2] deals with the rights conferred by registration of trademark. It would provide you with the exclusive right to use the registered trademark and also the right to relief in case of the mark’s infringement or wrongful use by a third party.
