Flat possession not given on time by the builder

I have booked a flat in noida extension in 2012, as per agreement builder has to provide the possession in june 2016. Still I have not got the possession however the construction work is going on. On RERA website, builder has provided the completion date as 31st december 2017. Now I am very frustrated and do not know what to do as it seems that the builder will take another 1 year to complete the work(as per current ground situation). I am paying rent & EMI also my daughter is now 4 year old and I want to take her admission. As currently I am in delhi and hence it is very difficult situation for me to choose the school location either Delhi or Noida.

You are entitled to claim damages for delay, cost and expenses incurred on account of delay and also refund of your deposited money with interest.

In case of property matters one must of patience otherwise you may not get your aprtment and you have face unnecessary civil litigation. During pendency of civil litigation normally the Court will ask both the parties to maintain status quo. It is advised to wait for one more year and smoothly get possession of apartment/flat. In the mean while issue a legal notice to the builder as bonafide effort.
