When a research analyst registered with SEBI allegedly commits any wrong, an inspection is made by the Board with regards to the complaint or information in accordance with Regulation 27 of the Securities and Exchange Board Of India (Research Analysts) Regulations, 2014. The Board can also take suo moto actions.
Based on the report, the Board gives the alleged research analyst to present their case. After due consideration, if found guilty or violating the provisions of the regulation, they are awarded punishment in accordance with Regulation 31 of the above-mentioned regulation. These punishments may include returning the fees or commission taken by the research analyst or prohibiting them from operating in the capital market. In special cases of violation by the research analysts, provisions of the Securities and Exchange Board of India (Intermediaries) Regulations, 2008 may apply.
