dismissal of petition

  • 3 Answers

A man works in Chennai in a company.Suddenly,he had to visit his native(Ranchi) for some purpose.During his stay in Ranchi he received a letter of dismissal from his job. He filed a petition in Jharkhand High Court on the basis of the letter received in Ranchi. There is no sub-ordinate office of the company in Ranchi. On what grounds court can dismiss his petition?

The court can dismiss the employee's petition on ground of want of jurisdiction. The defendant company may take the plea and very rightly so since neither any cause of action arose in territorial jurisdiction of Ranchi HC nor the defendant company has a registered office or its branch under the territorial jurisdiction of the aforesaid HC. Merely the recieving of letter of dimissal in jurisdiction of Ranchi HC will not ammount to sufficient cause of action.
