The website does not state the time period for which the demo software is valid. So for the purpose of taxation, it is being assumed that the demo software being made available to the customers is for a period of 3 months.   With regard to the filing of taxes, all online portals/ e-business, at the time of their incorporation/ formation, have to register with the Taxation Authorities. So first it should be seen whether SAG Infotech had registered itself with the Tax Authorities and attained documents such as PAN (Permanent Account Number), etc. Recently, the New Delhi government announced that a notification was being prepared, under which it would be mandatory for online portals to file tax returns quarterly. It has also been in the news that states like Karnataka, Kerala and Rajasthan have also started working on bringing e-commerce operators under the scanner by making it compulsory for them to file tax returns.[i]   Under the present laws of taxation, software programmes that are offered by your company are liable to be taxed. The taxes that are levied on these products are, Service tax and Value Added Tax (VAT). It is mandatory to pay both these taxes, as the Service Tax is collected by the Central Government, (presently the Service Tax rate is 14% across India) while on the other hand VAT is collected by the State Government.[ii] Therefore the VAT payable by companies/ entities varies from state to state. Since the Corporate Office of SAGInfotech is in Jaipur,[iii] hence the most recent rate of VAT payable for computer related software programmes and accessories is 5%.[iv]   Depending on the nature of the business (Firm, Domestic Company, etc.) as to how SAGInfotech has been registered with the Directorate of Income Tax, tax returns need to be filed. The website provides that SAG Infotech is a Proprietor Firm,[v] so the Tax returns will need to be filed as a ‘Firm’.
