Conversion of Farm land to Commercial land

Hi, I am planning to purchase a farm land in Bangalore, Karnataka. Is there any provision that it can be converted to commercial land by any means? Thanks! Regards, Prateek

According to S. 95 of Karnataka Land Revenue Act, 1964[1], you can apply to the Deputy Commissioner for such conversion of the nature of your agricultural land or farm land. However, there exist certain conditions due to which you may be denied permission, like:
  • If the diversion is likely to defeat the provisions of any law for the time being in force; or
  • If it is likely to cause a public nuisance; or
  • If it is not in the interests of the general public; or
  • If the said farm land lies within the limits of the Green Belt; etc.
  • Moreover, you can approach the Planning Authority under S. 14A of The Karnataka Town and Country Planning Act, 1961[2]. The Planning Authority, with the permission of the Karnataka State Government, may allow such changes in the land use or development from the outline development plan.

    The necessary pre-conditions for such change under this section:

  • all changes are in public interest;
  • the changes proposed do not contravene any of the provisions of this Act or any other law governing planning, development or use of land within the local planning area; and
  • the proposal for all such changes are published in one or more daily newspapers, having circulation in the area, inviting objections from the public within a period of not less than fifteen days from the date of publication as may be specified by the Planning Authority.
