Appointment against unreserved category post

When a reserved category candidate passed by getting  relaxation in Marks etc they can't get appointment against UNRESERVED CATEGORY post.. is there any law about this topic in IPC or anywhere else?

Sir, every state has its own reservation rules with minor variations and such a practice may be applicable. Please provide extra details for more accurate advice.

Nevertheless, the cap on reservation on a whole in government institutions is 50% and further this is divided among all deserving groups example 15 % for SC in certain fields. In such a circumstance an SC candidate can only be given concession and reservation within the quota specified for his community. Unreserved seats are given only on merit and cannot be encroached upon by reservations. However, there may be certain circumstances under which this can be done but the they would be specific to the area, institution or state as mentioned earlier.
