Advice regarding purchasing a property

Hi Sir, I am planning to purchase the building in Uppal, Laxminarayana Colony. The building has all papers and it is has registration and upto 30 years linked documents. But builder has constructed Ground + 1 floor without Muncipal Permission. Any problem I will face from Muncipal if I purchase the building without Municipal permission certificate. Please advice so that I will go ahead and purchase the building. Thanks, Jagadish

Without Muncipal Permission ? Legally said NO.

Hello, Adv. Krinjal Ahuja, from Mumbai.I am into Civil, Real Estate and property matters.

In property matters, youshould either purchase the land with the existing structure or only the future re-development rights. To purchase, only building, is not advisable.

Firstly, pleae clearify whether you are purchasing the land with building or only the development rights of the existing building, as your question doesn't comprises of all the facts?

Further, if you are purchasing the land only from the owner, then development whether legal or illegal doesnt matter, because even if Municipal take action, you can again develop the said land as per your sacntion plans and approvals.

If he your are purchasing only the development rights then too, the said existing structure shouldnt affect you.

Municipal officers will question the owner/builder who has constructed the building without permission and in worst condition they will demolish the building, thats it.
