Our real elder brother & sister will be, by executing Gift Deed, Gifting Shares to us (i.e. to their real younger sisters & brother). My Query: (a) What should be the appropriate denomination of Stamp Paper on which Gift Deed to be executed? (b) Is there any amount slab based on which denomination of Stamp Paper for executing Gift Deed is decided? (c) Is there any other duty / taxes to be payable to Govt.? In a consumer complaint filed by me to District forum notice was sent by district forum to the opposite party by speed post according to the practice of the forum. Opposite party as a strategy avoids receiving notice showing " DOOR LOCKED". The speed post track record showed "could not deliver/door locked/First intimation" Forum took this as notice served and goes with proceedings and deliver judgement in next three months. Clause 28A has clear stipulation on serving notice. There it is also stated that if notice is sent to opposite party at its address of office or place of residence it will be considered sufficient as notice served. In an Appeal after 16 months of judgement opposite party made this non receipt of notice a major issue.

I give below my case details for your perusal and advice. Myself K. Anupkumar along with my wife and 2 daughters are living in my parents’ house in the ground floor at Velachery. My parents are staying at the first floor. I have one sister who got married and living in Madipakkam. I am working in a private firm. My mother was running some local chits for more than 15 years. During the year 2016, we understand that she could not return the amount due to the people and they started complaining to us. Afterwards, we discussed with mother and found that she was having a huge debt of more than 50 lacs. After discussing with family members, we have decided to sell-off the parents’ house within a year and have taken a mortgage loan (by pledging parents’ house) for Rs.30 lacs in August 2016 for settling the debt of some people. We have distributed Rs.25 lacs to people and kept 5 lacs in bank for paying the EMI for 1 year. To our surprise, my mother left the house in October 2016 without informing anybody. We have given police complaint and filed habeas corpus also. We are still searching her. We are not able to sell the parents’ house since the property is in joint name. We do not understand how to pay bank’s EMI from August 2017 under the circumstances. Request your guidance / advise to proceed further. My email : anupvela@gmail.com

Hi, My brother was arrested today under a POSCO case. Police did not give exact details of the case, they refused to give us the copy of FIR and what exactly they have accused him of. First, we need to get him bail and then need to get him out of this case. The information so far we have is following - My brother is a store manager in Nike store in Gurgaon. A customer had visited the store on 19th May 2017. They have a 6-7 years old daughter. He had done 3 or 4 visits that day. Father asked my brother to take care of his daughter till he checks out stuff in the store. Requested him not to let her go out. Girl child started playing with a football, given by my brother. The girl kicked the ball towards trial room area and my brother went to pick it up. The girl followed him to trial room area. They were out of CCTV camera for barely a second. That family apparently had visited the store at least 3 times. All this is captured in the CCTV footage of the store. After 5 days of this event, the parents had filed a case under POSCO today 25th May 2017, saying that my brother had shown his private parts to the girl during that 1 second. Police had provided only this much detail to us. We waited a whole day in the police station for the report and other details. But the police has refused to give us any copy. We have CCTV footage as evidence for my brother's innocence. Store and Police have also seen the footage. Could someone please take up this case on urgent basis.

Dear Sir, my wife filed 498A and CrPC125 last year. I have a 3.5 year old son who is living with wife. I hadn’t filed for his custody and visitation till now, waiting to work it out mutually with wife but haven’t been successful till now. Today i came to know that my wife filed for divorce with interim custody of my son under HMA. I haven’t received notice of her divorce petition yet. My queries are: i. Now if I file for custody and visitation of my son under Guardian and Wards Act, will my GWA petition be ineffective/useless since wife has already asked for interim custody in her divorce petition or I shall go ahead and file GWA petition for custody and visitation? ii. In this situation, does my GWA petition for visitation and custody becomes legally weak in view of wife’s interim application for custody under HMA? iii. Can judge club my GWA petition with her interim custody application making it ineffective? Thank you very much. Govind

My question is before death my grand father who was ill, he gave registered will to my Dad. Now my dad wants to give rights to us of property. We are two brothers, one sister and my dad has one sister. My dad wants his property to be distributed between his two sons equally. My sister is married. Could you please let me know what kind of deed we have to go for, gift deed, register sale deed or transfer property through will on our name. We are not in position to pay huge amount for same. We do not want any type of challenge in future from any one. I do not want to get any challenge against my property from any one. I need solution on this. Please advise for this.
