Respected Sir, I am a partner of an unregistered partnership firm. We are 3 partners. I have been given Right of first refusal as Adjacent Plot Holder . I had submitted tender for the plot as an individual proprietor of adjacent plot. . My partnership firm has also submitted tender for the same plot. The filing person did not take authority letter for submitting tender from other Partners. Partnership tender bid came to be highest. Now as adjacent Plot holder having ROFR I claimed adjacent plot at the highest bided rate. MIDC CEO approved ROFR for me but Regional Officer turned down CEO Order and issued allotment letter to partnership firm. As a Partner I get 475 sqmtr and as individual adjacent plot holder by using ROFR I will get 750sqrmtrs of Plot. I have filed a WP in HC against the allotment order issued in favour of the Partnership firm by MIDC and not complying with CEO MIDC Order. Judge ordered to make other partners as respondents along with the partnership firms and MIDC Officials but said that as I am beneficiary in the partnership firm, No case can be made out for Interim Relief at this stage. Please advise regarding the points of argument and any other suggestions.

Myself, Ashish Ghosh, 2nd son of Late Kripamoy Ghosh & Late Juthika Ghosh lived in along with my elder brother (Ashok Ghosh) in the house made by my late father in 1974 at Behala Sarsuna under Kolkata Municipal Corporation (Ward No. 127). Both my parents passed away (father – 2004 & mother 2012) without making any will or separation / distribution of their property among us (we have no sisters). In our house there are Five (5) rooms. In the ground floor, three (3) rooms, dining, kitchen with toilet and in the first floor two rooms with asbestos shed with kitchen and toilets but no dining room. One of my unmarried aunt (Ms. Chhaya Ghosh) was living with our family and she also died last month. She does not have any claim or legal hires in our property. Please note, at the last days of my mother (Juthika Ghosh) and when it was needed to hospitalise her, I had to hand over all the entire ornaments of my mother to my elder brother (Ashok Ghosh) in presence of my mother, my aunt, myself, my wife, my elder brother and his wife, which he promised to refund 50% of the ornaments as my stake immediately after treatments but denied to refund the same afterwards (I had prepared the list of ornaments but was unable to get it signed by him). My aunt lived in my adjoining room and as she passed way, my elder brother locked that room and at present, he occupies four (4) out of five (5) rooms in our house illegally. My elder brother staying in first floor and locked two rooms in the ground floor. Moreover, both the main entrance gate and first floor gate of our house are also locked and key is with my elder brother and he denied access. I am living in a single room with some portion of the dining with kitchen and toilets in the ground floor with my wife and daughter (2.4 years) in distress condition. What should I do at this point of time? I belong to lower middle income group.

Dear SIR, I have loaned money to one of my far linked family member for building his house and marring his daughter. Since he did not have his account, for his money transaction he opened account for his daughter whose marriage was due to take place. I was staying in mumbai and had to make transaction through Punjab National bank from there and as well as from Mumbai. Total money was given to him through cash deposit and rtgs through the same bank and bank of Baroda starting from 2012 some part and then three or four time till 2014 December. They have returned some part of it but hardly 20%. Advocate says the continuty exist in this case and I have deposited the court fee and filed recovery suit. Please give your opinion and advise.

That land is under SBT bank auction for 50 lakhs, where sunder convinced me that he is going to get that property through bank auction and showed his EMD slip of 10%. As he is delaying day by day for Sale agreement. Recently I went to SBT bank and came to know that he deposited EMD 5 lakhs in Feb 2016 and took his EMD amount back on April 2016. At that time I came to know that he intentionally cheated me. Please guide me whether I should approach Police station or Court. Thank you....

A schedule property given to y and so on. Now y son says there is no share to x wife because this is self acquire property of y,abcde. Hence share not given to x wife saying he left from home in his childhood and lived in neibour village. Importantly y got alloted double worth i.e. 10000 share through A schedule. remaining a,b,c,d,e got alloted 5000/- worth. x self acquired some properties included in 1954 document. y son filed case against x grand sons saying they do not have any right in A schedule property. y son has not provided any document of proof that properties acquired only by y,a,b,c,d,e except 1954 document. Please advise us whether x wife got 1/2 share of A schedule property. x grandchildren produced x self acquired property documents before court saying these properties included in 1954 document. The meaning is properties mentioned in 1954 document are not only self acquired by y,a,b,c,d,e but also x.
