Hello, My father bought a LIG 1 BHK flat, named my mother as partner (with no financial contribution) and I and my elder brother as 50-50 nominee.. My father had passed away few yrs ago, and my mother now owns (50% of total property + 1/3 from the rest of 50%... me and my brother are now 1/3 % holders (each) from that other 50% share.) Now my brother is posted to Mumbai and has kept most of his belongings- bed almirah etc and I'm living in this property since 2011 onwards.. my mother is harassing me to leave this property else she will serve me a legal notice on pretext of me disturbing a 60yrs old Sr. Citizen & court has provision to ask the kids to leave parental house. I have been paying electricity, guard LPG gas contribution and working in a private unstable job.Being a female it is very difficult for me to deal with her in this situation. She has named my brother as a nominee of her share of entire property with all household goods and now they have also started taking her side and had in the past tried to abuse me physically for which Police was called in 2 times. please suggest the right procedure to obtain a stay order against my legal right to live in this property where I'm a partial 17% owner. Thx

I had purchased a land from State financial corporation in 1997 and I had registered the same to my uncle from him I had taken the same property for lease for 20 years. The lease is registered and it will be completed by next year. as of now, as the land value had increased and disputes arose in the family, they are pressuring me to vacate the same without the completion of the lease. I need the same premises for 5 more years as I have to shift the same machinery or infrastructure to another place which takes much time. I had paid the lease amount till 2013. Actual lease amount as per document is only 500.00 but I am paying 8800.00 every month as on date. Can you suggest any for my above problem.

I bought a property a year ago that was a ground floor(177 sq m) in a 4 floor building in delhi. It was old constructed (144 sq m) and floor was not in a position to live. so i started renovating it and without any permission from municipal corporation i extended a room in the open area i.e verandah and covered nearly 12 sq.m. in my premises. I got a letter from municipal corporation regarding unauthorized construction going on of all the floors though only the fourth floor was under construction at that time and it was lantered by the time i bought the ground floor. I came to know that it was unauthorized and the complaint was basically for his fault. But municipal corporation booked whole building and after that i came to know through an assessment(self assessment property tax form 2006-07) from municipal corporation that my house tax was paid for a covered area of around 107 sq m. Then i got to know through municipal corporation and my early land lords that an assessment was done in around 1980's which shows a covered area of 77 sq mt. Now the Municipal corporation says that the data does not tally to actual construction stating this it sent a letter to whole building to demolish the unauthorized construction. I however am willing to give the penalty for my construction if it is a way to rectify my mistake. I do not how to proceed into this and i do not have any map sanctioned. Is there any way i can get my property regularized and i do not wish any demolition to take place.

Can my wife (1996 married hindu woman) claim right to her share in her mother's agricultural property after her both parents died (the property in question was in turn inherited by her mother {or my saas}, from her parents as she was single child). Is it possible? My wife's mother died in 2010. The properties in question are in Madhi, Distt Rewa, MP (90% by area), and in Kanpur Nagar, U.P. (10% by area)

Hi Mr. Lawyers,  I have a question, which is odd in the nature. Point 1: What if i want to "refuse" my property share from my father and mother and grand parents, which I inherit by any act of Indian law. And I want that share of my property from fathers and ancestor's, should be distributed equally to remaining siblings (who is heir). Point 2: If there is any Debt in Banks, which was taken by my Father, I am ready to pay them in the first place. And I want to exclude my siblings from this dispute. I want to take whole and sole responsibility to pay the debt. If our Great Indian Law has the provision. Then let me know by which sections I can prepare a proper document or notary or suitable legal document (I mean best option). If I want to prepare the proper document, Then what should be the stamp paper value. I think you people got my questions. Please let me know the answers.

We had given agricultural land on rent in 1995 for 99 years with mentioning in the rent agreement that he can change the use of the land in future and even for non agricultural purpose and had made an agreement on 20 Rs stamp paper and the document was not registered and this rent agreement will be applicable on legal heirs also and we have collected rent of 10 years each slab till today and we are getting the rent periodically and can we now get the land back from the person to whom we have rented?

I have purchased a shop in a building in the year 2004 for Rs.3 Lacs.A registered agreement for sale was made in the same year.The possession of the shop has been given in 2009 and presently I am running my business from the shop for the past 8 years.Due to some financial problems I could not register the shop in my name.When I approached the landlord for the registration,he denied as he does not want to give the documents required for registration.As such,nearly a year ago I have sent him a legal notice.But he has not replied yet.I would like to mention that the amount was paid in installments.But out of Rs.3 Lacs,I have got receipts for only Rs.2.20 Lacs as the remaining amount was paid without receipt on the basis of good faith.It is mentioned in the agreement that only after the payment of the total amount I can take possession of the room.Kindly advice what to do.If I file a case against the landlord will he be able to demand the amount for which I do not have any receipt?Also I want to know whether he can evict me from the shop and resale it?If I am ready to pay the amount of Rs.80000 for which I don't have any receipt of payment can the landlord deny it and demand in the court to cancel the agreement?Is there any time limit for such agreement as I have heard that an agreement is valid for only three years?On what basis I can file the case in the court? Also I would like to state that I have been running my business from the said property since 1969 which is mentioned in the agreement for sale(the construction of the building started in the year 2004).Will this point help me in fighting my case?The landlord has also not provided the basic amenities like water,toilet,etc. which were mentioned in the agreement.
