I hv filed a pwdv and a divorce case against my husband with allegations of dowry, physicalland mental harassment, drinking and desertion for 5 years. I have sumitted all evidences in court in my pwdv case,now my husband has objected to the return of these documents which i shall be requiring in my mat case as well. He is harrassing me in my divorce case and delaying the matter. The hearing for my divorce case is on 3.6.2017. Please advice my husband is a central gov.employee. What are the ways by which I can also put a pressure on him to come to a conclusion.

Dear Sir, my wife filed 498A and CrPC125 last year. I have a 3.5 year old son who is living with wife. I hadn’t filed for his custody and visitation till now, waiting to work it out mutually with wife but haven’t been successful till now. Today i came to know that my wife filed for divorce with interim custody of my son under HMA. I haven’t received notice of her divorce petition yet. My queries are: i. Now if I file for custody and visitation of my son under Guardian and Wards Act, will my GWA petition be ineffective/useless since wife has already asked for interim custody in her divorce petition or I shall go ahead and file GWA petition for custody and visitation? ii. In this situation, does my GWA petition for visitation and custody becomes legally weak in view of wife’s interim application for custody under HMA? iii. Can judge club my GWA petition with her interim custody application making it ineffective? Thank you very much. Govind

My question is before death my grand father who was ill, he gave registered will to my Dad. Now my dad wants to give rights to us of property. We are two brothers, one sister and my dad has one sister. My dad wants his property to be distributed between his two sons equally. My sister is married. Could you please let me know what kind of deed we have to go for, gift deed, register sale deed or transfer property through will on our name. We are not in position to pay huge amount for same. We do not want any type of challenge in future from any one. I do not want to get any challenge against my property from any one. I need solution on this. Please advise for this.

Hello, My father bought a LIG 1 BHK flat, named my mother as partner (with no financial contribution) and I and my elder brother as 50-50 nominee.. My father had passed away few yrs ago, and my mother now owns (50% of total property + 1/3 from the rest of 50%... me and my brother are now 1/3 % holders (each) from that other 50% share.) Now my brother is posted to Mumbai and has kept most of his belongings- bed almirah etc and I'm living in this property since 2011 onwards.. my mother is harassing me to leave this property else she will serve me a legal notice on pretext of me disturbing a 60yrs old Sr. Citizen & court has provision to ask the kids to leave parental house. I have been paying electricity, guard LPG gas contribution and working in a private unstable job.Being a female it is very difficult for me to deal with her in this situation. She has named my brother as a nominee of her share of entire property with all household goods and now they have also started taking her side and had in the past tried to abuse me physically for which Police was called in 2 times. please suggest the right procedure to obtain a stay order against my legal right to live in this property where I'm a partial 17% owner. Hi Mr. Lawyers,  I have a question, which is odd in the nature. Point 1: What if i want to "refuse" my property share from my father and mother and grand parents, which I inherit by any act of Indian law. And I want that share of my property from fathers and ancestor's, should be distributed equally to remaining siblings (who is heir). Point 2: If there is any Debt in Banks, which was taken by my Father, I am ready to pay them in the first place. And I want to exclude my siblings from this dispute. I want to take whole and sole responsibility to pay the debt. If our Great Indian Law has the provision. Then let me know by which sections I can prepare a proper document or notary or suitable legal document (I mean best option). If I want to prepare the proper document, Then what should be the stamp paper value. I think you people got my questions. Please let me know the answers.

Hi . I am a govt. employee and want to marry a lady with two kids. She is already married but her husband left her and ran away 4 years back. That guy was a ruined human being and during his stay he had done all sort of cruelty on her. She has filed divorce but nothing is happening . I want to marry her and adopt both the kids . my questions : 1.Can I marry her before divorce ? 2.what are the options I have ? There is only 1% chance of that guy filing any case against me. 3. No one is coming from husband's side on court hearings . 4. even if they file case against me , will the order be in favour of me as the Supreme Court keeps educational and social welfare of children above everything ? 5. they are lot of audio recording to prove he is not a nice guy and not safe for kids to live with him.
